MOORISH REPUBLIC OF NEW KEMIT CONSTITUTION AND BY-LAWS

ACT 1. – The officers of the Temple of New Kemit are known as Ministers: Executive: Grand Chief, Assistant Chief, Secretary, Treasurer specialized and general Ministers. The Executive Chief and Assistant Chief are in power to enforce laws with the assistance of the Grand Elders of Moorish Temple of New Kemit. The Executive Chief, Assistant, Secretary and Treasurer are Supreme jurisdiction over all subordinate Temples. The Chief(s) Ministers are to assist the Grand Elders in all affairs as they live in Love, Truth, Peace, Freedom and Justice and are known to the members of Moorish Temple of New Kemit and oversee the affairs of the Ancestors. The Secretary is the scribe and recorder of information of meetings and keeper of records and is subordinate to the Executive and Assistant Ministers. The Treasurer is responsible for dues of members and accounts of the Temple of New Kemit. The general Ministers are to perform all duties included in the Rites of Passage. The Elders serve as examples and guidance according to divine laws of the Ancestors and Maat.
ACT 2 -- All meetings are to be opened and closed promptly according to the Circle Seven of Love, Truth, Peace, Freedom and Justice. Friday is our Holy day of rest because it is the day of rest for all Moors all over the world.
ACT 3 – Love, Truth, Peace, Freedom and Justice must be proclaimed and practiced by all members of the Moorish Temple of New Kemit. No member is to put in danger or falsely accuse his brother or sister because the Creator is Peace.
ACT 4 -- All members must preserve these laws, and all members must obey the laws of the Moorish Temple of New Kemit, because by being a Moor you must be part and partial of the government and must live life accordingly.
ACT 5 -- The Moorish Temple of New Kemit are not to cause confusion or to overthrow the laws of the said government but affirm indigenous natural rights hereby.
ACT 6 – With us all members must proclaim their nationality and teach that our people their nationality and their Divine Creeds that they know they are part and partial to the said community, and know that they are not divided by religion, politics, gender or names given to involuntary servants by their captives in 1555 and lasted until 1865 during the time of involuntary servitude and slavery. We are now in a new era of time and all men and women must proclaim their free national name to be recognized by the government(s) in which they live and all nations on earth. The Moors are the ancient descendants of Indigenous peoples from America and the North and Western shores of Al Kebulan.
ACT 7 – All members must promptly attend their meetings and part and partial of the uplifting acts of the Moorish Temple of New Kemit. Members take an Oath to never disclose any internal information of the Moorish Temple of New Kemit and to protect the members of the order. All members must recognize the Ancestors and rites of Passage to be in good standing. Members must pay their dues that are apportioned and keep in line with all necessities of The Moorish Temple of New Kemit, and then you are entitled to the name “faithful”. Husbands must respect your wives and wives must respect their husbands. Parents must protect and take care of your offspring. Children must obey their parents and elders of the community. All Moorish Citizens must strive to keep the hearts and minds pure of MAAT and become part of uplifting humanity.
ACT 8- The Moorish Temple of New Kemit is in alliance with the Treaty of Peace and Friendship of Morocco first ratified 1787 and Treaty of Camp Holmes 1835 and under the protection and immunities implied by these treaties, ACT -9 All members of Moorish Temple New Kemit shall be registered as Moorish Nationality and filed by a publications, and approved by a Minister and secured at the hall of records
ACT-10 All member must obey and abide by this Constitution, Treaty of Peace and Friendship and all other Moorish Treaties with the America's, The laws of the United States may have jurisdiction complaint to the Moorish Treaties and as long as such laws do not violate the indigenous human rights of Moorish members of their rights to religion, tradition and customs in accord with all Moorish Treaties.
ACT-11 Moorish member have a right to relinquish membership and/or forfeit membership at any time, and in addition add other Nationality to their person, and have a right to practice those customs, traditions, and religious beliefs, but no other Nationality shall have no affect or jurisdiction in New Kemit Temple or Government. No person shall force through coercion Non Moorish Nationality, Customs, Traditions, Religion on another member of New Kemit or use Non Moorish beliefs to affect the affairs and estates of Moorish New Kemit.
ACT-12 Moorish New Kemit has the right to remove any member from its membership if any violates the laws of the land, the Constitution and By-law or any Moorish Treaties with America, that shall damage the image, reputation, and any affairs of Temple of New Kemit. The member has a right to a hearing by the Minister, may choose the appropriate punishment in accordance with the violation or violations. Act- 12 (a) Moorish Citizen(s) can be suspended and/or abolished from its membership for violation of laws of the land, this Constitution or Moorish Treaties with America's.
TEMPLE OF NEW KEMIT BY LAWS AS CODIFIED IN CONJUNCTION WITH CONSTITUTION CHAPTER 1 BY LAWS
Code 1.01 All codes must be in compliance with the Temple of New Kemit Constitution and By laws.
Code 2.01 The Constitution and Moorish and Indigenous Treaties are used for guidance to the temple by laws or codes if the codes do not have a provision or if any laws are vague in accordance with these codes.
Code 3.01 The Temple of New Kemit is made up of The Executive Chief Minister, Assistance Chief Minister, general and specialized Ministers and Minister of Treasurer, for any reason The Executive Chief Minister can resign or step down The Assistance Chief minister will then be appointed as Executive Chief Minister and then selection process shall take place to fill The Assistance Chief minister position. (a) This process can be incessant for any position of the Temple and Religious Government , but before vacating the position, the trusted appointed member must assist the new appointed member with all important affairs before vacating office.
Code. 4.01 All members of the New Kemit must pay annual dues of 36 dollars U.S. Currency to have access to the Temple or any Institution associated with New Kemit.
Code 5.01 Any member of New Kemit can be banned or suspended from the Temple for violating the Oaths or laws of the land or any rules of New Kemit, Treaties or Constitution;along with disrupting the business of the Temple or Government.
Code 6.01 No Code shall infringe or disenfranchise any member right to a religion, any member has the right to practice the religion of his choice as long as they follow Moorish Constitution and do not use their Non Moorish beliefs, tradition or customs to influence the affairs of Temple or Government.
Code 7.01 The Temple has a forgiveness system or disciplinary standard to allow mistake, The appointed temple members and elders shall decide the disciplinary action appropriate, and shall vote on such decision. If the votes are deadlocked, then the executive chief shall make such a decision that's deemed appropriate.
Code 8.01 all appointed members or Governmental Officials shall be members of New Kemit and must be declared as Moorish Descent.
Code 9:01 No Appointed Temple Member or Governmental Official shall misappropriate any funds that is used to facilitate the business of Temple or Government
Code 10.01 If any member of New Kemit appointed or non appointed, misappropriate funds for any reason, other than official business of the institution the funds are meant for use, this shall be deemed as fraud. This action can lead to removal of office , indefinite suspension and/or prosecution of the state of Ohio in accordance with the appropriate revised code.
Code 11.01 All appointed members which include governmental personnel and Temple appointed Members shall conduct themselves in such a way that maintains the integrity of Moorish New Kemit to promote and maintain the trust of the members of Moorish New Kemit.
Code 12.01 Positions of Influence. An appointed member or official shall not allow family, social, political, or other relationships to influence their conduct or judgment. An appointed member or official shall not lend the prestige of their position to advance their private interests or others and shall not convey or permit others to convey the impression that they are in a special position to influence others in such a way that is against Moorish New Kemit or any Government Institution of New Kemit .
Code 13.01 Memberships in Organizations that Practice Invidious Discrimination. No member shall not hold membership in any organization that practices invidious discrimination on the basis of race, gender, religion, or national origin.
Code 14.01 Activities to Improve the Law. An Appointed Member of the Temple Officer may engage in activities to improve the law, the legal system, and the administration of justice, as it relates to indigenous people and provided those activities do not cast doubt on the capacity to act or set trends of biasness, or demeaning and/or interfere with the proper performance of appointed member or Officers duties.
Code 15.01 Trusted appointed Temple Members and Officers shall treat members with respect and kindness while acting in their Professional Capacity.
Code 16.01 All trusted appointed Members or Officers must work in a way to promote the Unity of Moorish Community and Temple.
Code 17.01 All Trusted Appointed Temple Members shall comply with the mission, objective and Goals of the Temple.
Code 18.01 The Temple of New Kemit or Government of New Kemit shall follow Moorish Beliefs Tradition and Customs.
Code 19.01 These Codes can be renumbered, Amend, Revised, Added to, Removed and repealed
CHAPTER 2 MEMBERSHIP
CODE 20.01 All members have the right to practice their own personal religion alongside the Ancestral recognition a) All members are under oath by contract not to discuss religious business with non members. b) All members pledge allegiance to the Moorish Temple of New Kemit.
CODE 20.02 All members have a right to relinquish membership.
CODE 20.03 All members can be a part of Temple or Government
CODE 20.03 All members have a right to vote on Temple and Governmental issues
CODE 20.04 All members have a right to vote on Governmental elections
CODE 20.05 All members have a right to be apart of the temple and any program the free to the Temple of new Kemit
CODE: 20.05 b All members have a right to hearing by Temple Minister or elders before subjection to suspension, removal, or fines and all members have the right to waive such hearing to expedite such matters to resume the business affairs of New Kemit.
CODE 20.06 All members have a right to appeal their decision.
CODE 20:07 All members have the right to participate in ll temple and government activities
CODE 20:08 Freedom of speech and assembly among members.
CODE 20:09 safe against improper discipline
CODE 20:10 all Members have a right to seek impeachment or removal of any official for serious misconduct
CHAPTER 3 DUTIES ELECTED OFFICIAL AND GOVERNMENT CODE
30:01 Financial Safeguards - Ministeres have a duty to manage the funds and property of the Temple solely for the benefit of its members in accordance with the New Kemit constitution and Temple by laws.
CODE 30:02 Ministers, Officers or members who embezzle or steal union funds or other assets commit a Federal crime punishable by a fine and/or imprisonment.
CODE 30:03 Bonding - officers or employees who handle funds or property must be bonded to provide protection against losses if their Temple or Government has property and annual financial receipts which exceed $5,000.No bonding is needed if funds and property is 5,000 or less.
CODE 30:04 Local Organization Reports - Ministers must: file initial information reports or monthly minutes and annual financial reports and retain the records necessary to verify the reports for at least five years.
CODE 30:05 Minister Reports - Ministers, officers and employees must file reports concerning any loans and benefits received from, or certain financial interests in, representing any businesses that deal with the Temple or Government.
CODE 30:06 Grand Minister Elections – The Temple and Government may hold elections of Head Ministers of local temples by secret ballot if there is death, corruption or voluntarily step down . Conduct elections in accordance with their constitution and bylaws and preserve all records for one year. Mail a notice of election to every member at least 15 days prior to the election. comply with a candidate’s request to distribute campaign material and not use Temple or Government funds or resources to promote any permit candidates to have election observers. allow candidates to inspect the Temple membership list once within 30 days prior to the election. Restrictions on Holding Office - A person convicted of felony crimes may not serve as an Grand Chief Minister, treasurer, or other representative of a Temple or Governmental position for up to 7 years.
CODE 30:06 Loans - A Temple or Government may permit loans to members, or Ministers to help facilitate the need of members and Officers must not let outstanding loans go past 30 days or loan more than 500 U.S. Dollars at a time unless there is an insured return, by putting up assets equal to the amount of loan or more.
CODES 30:07. Fines - Temple members and Ministers may be fined, fines must be paid to retain membership in good standing or Temple officers position. The fine may be assessed in accordance to any violation that is not permitted and if any member or staff convicted of any willful violation also may be under other sanction/including suspension if it's shown to be willful or intentional.
CHAPTER 4 ELDERSHIP/MINISTERS
CODES 30:08 - Selection of eldership is by 2/3 of vote by eligible members and Ministers.
CODES 30.09 - There must be a minimum of three elders to maintain the Grand Eldership Body. If the Eldership body is not operating then the responsibility is on the ministers.
CODES 30.10 - Elders must meet once a month.
DUTIES OF MINISTER
CODES 30.11 - All Ministers are required to deal with domestic disputes between members.
CODES 30.12 - Ministers may perform certain rituals, ceremonies, prayers and rites needed by the community and Temple.
CODES 30.13 Ministers must take an oath of ministry.
CODES 30.14 There shall be specialized Ministers of defense, law, Treasury, finance, etc.
